Maybe Sanders Losing WA Supreme Court is Poetic Justice?

Posted by mrfixit on November 15, 2010

I think on balance Justice Sanders is a strong proponent of individual rights, but I’m now not sure his judgment was always sound.

I was not aware of this earlier (but I still would have supported him over his opponent):

“And Sanders says he was only speaking his conscience when, in 2008, he stood up and yelled “tyrant!” at then-U.S. Attorney General Michael Mukasey at black-tie dinner in Washington, D.C., for The Federalist Society, a conservative legal group. Sanders later released a statement citing inadequate access to the legal system for detainees at Guantanamo Bay and the importance of the Geneva Conventions.”

Well, well.  At the minimum this is misplaced anger.  The terrorists captured in battle fighting our forces, that are held at Gitmo are treated way too nice in any rational analysis.  It is also fact that a reason we have not been able to shut it down is the US laws that prevent us from delivering these murderous thugs back to the nations from which they came IF THOSE countries actually use torture!  Yep, we are PROTECTING these guys largely from their countries of origin!

Is Gitmo a great idea – No>.  But do you have a better idea of how to hold violent terrorists captured in battle?

It is a reflection of our policies, our near suicidal PC handcuffs that have resulted in Gitmo.  We used to identify the enemy and defeat them.  We are not into inhumane treatment, but we used to be about self preservation.  In the Geneva conventions of war, the combatants are held for the duration of the conflict, without trial!

However, these guys don’t even deserve that much, since they choose to operate outside the boundaries of Geneva, as unlawful enemy combatants without ID and uniform, they don’t even qualify for Geneva protections, but we have granted them anyway.

If that is so outrageous to Sanders to have him call those our side tyrants, well then perhaps he lost for good reason.

You see it got him ZERO credit amongst the Bush hating left wing! –  ZERO credit.

Sadly, he lost to a guy who doesn’t seem to understand that human life in its most innocent form deserves respect and protection from government.   I know this from his list of endorsements, which includes the pro-abortion group, NARAL.  (Add to that, big labor, enviro-whackos, Gay Whackos, and Democrats). Enough said on that.

So, what is the lesson here?  Well, if you attack your own side over outrage for the supposed rights of murderous terrorists at Gitmo, well that misplaced anger could contribute to you losing a seat to protect the rights of truly innocent people – the yet to be born.

Pick your fights wisely.  Place your most vigorous effort where it might actually be meaningful.  Worries about rights of terrorists picked up in battle are not really the most important, if you must, get to those only after the higher priorities are safe.

I voted for Sanders even though I knew about his tyrant call. At least he seems to judge more conservatively then I believe a judge from Bainbridge Island will.
